Our owner occupier client proposed a two-storey rear extension at this detached property with a sloping rear garden.
Following the receipt of planning consent we visited the site and advised our client on the impact of the proposals on the next door neighbour. The main issue was the depth of the proposed foundations, which due to the sloping site would be deeper and within 3.0 m of the neighbour’s foundation. We considered the involvement of The Party Wall etc., Act 1996 and gave advice on responsibilities, liabilities, likely costs and timescales.
As appointed surveyors we served a notice under The Party Wall Act on behalf of the building owner. We negotiated and agreed an Award under the Act with the neighbour’s appointed surveyor and also agreed a schedule of condition on the neighbour’s property before work started.
